Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you") and Streamix ("we," "us," "our"), a privacy-focused video hosting service operated by an individual.

By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must immediately cease using the Service.

1. Service Description

Streamix is a privacy-focused video hosting platform that allows users to upload, store, and share video content. We operate as a neutral technical hosting provider.

Access Model:

Viewing videos: No registration required
Uploading videos: User account registration required

The Service is provided on an "as available" basis. We do not guarantee continuous availability, uptime, error-free operation, or any specific level of service performance.

2. Privacy-Focused Approach

Streamix is designed with user privacy as a core principle. In furtherance of this commitment:

We do not scan, review, verify, or pre-moderate user-uploaded content
We do not proactively monitor content before or after publication
We operate as a neutral hosting platform and do not exercise editorial control over content
We do not make representations or guarantees regarding the nature, legality, accuracy, or copyright status of user-uploaded material

This privacy-focused approach means that a wide variety of user-generated content exists on the platform, ranging from general audience material to content intended for mature audiences (18+).

Any actions taken under these Terms are based on technical indicators, user reports, legal notices, or information otherwise lawfully available to us.

3. User Responsibility and Content Liability

Users are solely and exclusively responsible for all content they upload to the Service.

By uploading content, you represent, warrant, and covenant that:

You own all rights to the content or have obtained all necessary permissions, licenses, and authorizations
Your content complies with all applicable local, national, and international laws and regulations
Your content does not infringe any third-party intellectual property rights, privacy rights, or other legal rights
You have obtained all necessary consents from individuals appearing in your content
You accept full legal responsibility for the content you upload

Streamix acts solely as a video hosting provider and is not responsible for user-uploaded content. We do not verify, endorse, or guarantee the legality or appropriateness of any user content.

4. Eligibility and Age Requirements

You must be at least 18 years of age to create an account and upload content to the Service. By creating an account, you represent and warrant that you meet this age requirement.

The Service may contain content of varying types and suitability levels. Some content may be appropriate for general audiences, while other content may be intended for mature audiences only. Users access content at their own discretion and risk.

Viewing content on the Service does not require age verification. Users and parents or legal guardians are solely responsible for determining whether content accessed through the Service is appropriate.

5. User Accounts

5.1 Account Registration

To upload videos, you must create an account. You agree to:

Provide accurate and current registration information
Maintain the security and confidentiality of your account credentials
Accept responsibility for all activities that occur under your account
Notify us immediately of any unauthorized account access

5.2 Account Deletion

Users cannot delete their accounts directly through the platform interface. However, you may request account deletion by contacting us at [email protected]. We will process legitimate deletion requests within a reasonable timeframe, subject to:

Technical limitations and backup retention periods
Legal obligations requiring data preservation
Ongoing investigations or legal proceedings

6. Content Ownership and License

6.1 Ownership

You retain all ownership rights to videos and content you upload to the Service.

6.2 License to Us

By uploading content, you grant Streamix a non-exclusive, worldwide, royalty-free, sublicensable license to store, reproduce, transmit, display, and distribute your content solely for the purpose of operating and providing the Service. This includes the right to:

Store content on our servers and infrastructure
Deliver and stream content to viewers
Transcode and optimize content for different devices and bandwidth conditions
Create backup copies for operational purposes
Generate thumbnails and preview images

This license terminates when you delete your content, subject to reasonable technical delays for caching and backup systems.

7. Prohibited Content and Conduct

Any type of video content is allowed provided it is legal under applicable law.

The following content is strictly prohibited:

7.1 Illegal Content

Content that violates applicable laws in Ukraine or the user's jurisdiction
Child sexual abuse material (CSAM) or any content depicting child exploitation
Content promoting terrorism or violent extremism
Content facilitating illegal activities (drug trafficking, human trafficking, weapons sales, fraud, etc.)

7.2 Intellectual Property Violations

Copyrighted material uploaded without proper authorization, permission, or license from the copyright holder
Content that infringes trademarks, patents, or other intellectual property rights

7.3 Harmful Content

Hate speech promoting violence or discrimination
Credible threats of violence against individuals or groups
Malware, viruses, or malicious code
Phishing attempts or fraudulent schemes

7.4 Service Abuse

The following activities are prohibited:

Excessive or abnormal consumption of server resources, bandwidth, or storage that materially degrades Service performance or availability for other users
Automated or scripted uploading, downloading, or access patterns that place undue load on the Service infrastructure
Attempts to bypass, disable, or interfere with technical limitations, security mechanisms, or access controls
Any activity that disrupts or interferes with the normal operation of the Service or the experience of other users

7.5 Enforcement

We reserve the right to determine, in our sole discretion, whether content or conduct violates these Terms. The above examples are illustrative and non-exhaustive.

8. Content Moderation and Takedown Policy

8.1 No Proactive Moderation

We do not proactively monitor, scan, review, or moderate user-uploaded content. As a privacy-focused hosting provider, we do not examine content before or after it is published on the platform.

8.2 Reactive Takedown Process

Content may be removed from the Service if:

It is reported by authorized agents, copyright holders, law enforcement, or trusted parties
We receive a valid legal complaint or court order
We become aware through any means that content violates these Terms or applicable law
We determine, in our sole discretion, that content poses legal or operational risks

8.3 Investigation and Removal

Upon receiving a report or becoming aware of potentially violative content, we will:

Conduct a limited assessment of the reported material based on the information available to us
Determine whether removal is warranted
Take appropriate action, which may include content removal, account warning, suspension, or termination

We are not obligated to provide specific reasons for content removal or account actions.

8.4 Account Consequences

First violation: Warning and content removal
Repeated violations: Account suspension or permanent termination
Severe violations: Immediate permanent account termination without warning

Severe violations include, but are not limited to: CSAM, terrorism, extreme violence, systematic copyright infringement, or severe service abuse.

8.5 Feature Restrictions

We may disable specific features such as direct linking, embedding, or public access if we detect:

Excessive bandwidth usage
Abuse of service resources
Patterns of prohibited content

9. Copyright Policy and Takedown Procedure

9.1 Copyright Respect

We respect intellectual property rights. However, we do not actively check, verify, or monitor the copyright status of uploaded content. Users are solely responsible for ensuring they have the right to upload and distribute their content.

9.2 Copyright Infringement Reports

If you believe your copyrighted work has been uploaded without authorization, you may submit a copyright takedown request to [email protected] containing:

Your contact information (name, address, email, phone)
Identification of the copyrighted work you claim has been infringed
Identification of the infringing material and its location on the Service (URL)
A statement that you have a good faith belief that the use is not authorized
A statement, under penalty of perjury, that the information is accurate and you are authorized to act
Your physical or electronic signature

9.3 Repeat Infringer Policy

Accounts that repeatedly upload infringing content or receive multiple valid copyright complaints may be suspended or permanently terminated.

9.4 Counter-Notification

If you believe your content was removed in error, you may submit a counter-notification to [email protected] with:

Your contact information
Identification of the removed content and its former location
A statement under penalty of perjury that the content was removed by mistake or misidentification
Your consent to jurisdiction in your location
Your signature

10. Reporting Illegal Content

If you encounter content that you believe is illegal, particularly content involving child exploitation, terrorism, or other serious criminal activity, please report it immediately to: [email protected]

We may cooperate with law enforcement agencies and report suspected illegal content to appropriate authorities where required by applicable law.

Do not download, distribute, or interact with illegal content. Report it and allow authorities to handle it appropriately.

11. Paid Services and Pricing

11.1 Service Tiers

Streamix offers both free and paid service tiers. Paid subscriptions provide enhanced features such as increased storage capacity, higher bandwidth allocations, or other premium functionality.

11.2 Pricing

Subscription pricing is displayed on the Service website. Pricing and service plans may be changed at any time at our sole discretion. We will provide reasonable notice of price changes to existing subscribers.

11.3 No Refunds

All payments for paid services are final and non-refundable, except where required by applicable law. We do not provide refunds or credits for:

Partial subscription periods or unused time
Unused storage, bandwidth, or features
Accounts terminated for Terms violations
Service dissatisfaction or change of preference
Service interruptions, downtime, or technical issues

11.4 Subscription Cancellation

You may cancel your paid subscription at any time. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until that time, but no refund will be provided for the remaining period.

12. Privacy Policy

13. Disclaimers and Limitations of Liability

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
Warranties regarding service availability, uptime, or error-free operation
Warranties regarding the accuracy, legality, or safety of user content
Warranties that defects will be corrected or that the service will meet your requirements

13.2 No Responsibility for User Content

WE ARE NOT RESPONSIBLE FOR USER-UPLOADED CONTENT. You acknowledge and agree that:

User content is the sole responsibility of the person who uploaded it
We do not verify, endorse, or guarantee the legality, accuracy, or appropriateness of user content
We are not liable for any content that violates your rights or the rights of third parties
You access and use user content at your own risk

13.3 No Liability for Loss or Damage

WE ARE NOT RESPONSIBLE FOR:

Service downtime, interruptions, or unavailability
Loss, corruption, or deletion of your content or data
Unauthorized access to your account or content
Any damages arising from your use of the Service
Actions of other users or third parties

13.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL Streamix OR ITS OPERATOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

Loss of profits, revenue, or business opportunities
Loss of data or content
Loss of goodwill or reputation
Cost of substitute services
Any other intangible losses

THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE) AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

13.5 Maximum Liability

Our total aggregate liability to you for all claims arising from these Terms or your use of the Service shall not exceed the greater of: (a) the total amount you paid us in the twelve (12) months preceding the claim, or (b) €50.

13.6 User Assumes All Risk

You use the Service entirely at your own risk. We make no representations or warranties about the Service's suitability for your purposes.

14. Indemnification

You agree to indemnify, defend, and hold harmless Streamix and its operator from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or relating to:

Content you upload to the Service
Your use or misuse of the Service
Your violation of these Terms
Your violation of any law or regulation
Your violation of any third-party rights, including intellectual property rights, privacy rights, or other proprietary rights
Any activity conducted through your account

We reserve the right to assume exclusive defense and control of any matter subject to indemnification by you. You agree to cooperate with our defense of such claims.

15. Service Modifications and Termination

15.1 Service Changes

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without notice or liability. This includes:

Adding, removing, or modifying features and functionality
Imposing or changing technical limitations (file sizes, storage quotas, bandwidth limits)
Changing how the Service operates

15.2 Account Termination by Us

We may suspend or terminate your account at any time, with or without notice, for any reason or no reason, including but not limited to:

Violation of these Terms
Illegal activity or prohibited content
Excessive resource consumption or service abuse
Extended periods of inactivity
At our sole discretion for operational, legal, or business reasons

15.3 Effect of Termination

Upon account termination:

Your access to the Service will immediately cease
Your content may be deleted in accordance with our data retention policies
We are not obligated to provide you with copies of your content
You remain liable for all obligations incurred before termination
No refunds will be provided

16. Governing Law and Jurisdiction

16.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ukraine, without regard to conflict of law principles.

16.2 Jurisdiction

You agree to submit to the exclusive jurisdiction of the courts of Ukraine for any disputes arising from or relating to these Terms or your use of the Service. You waive any objection to venue or inconvenient forum.

16.3 Dispute Resolution

Before initiating formal legal proceedings, parties agree to attempt informal resolution by contacting each other and negotiating in good faith.

17. General Provisions

17.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Streamix regarding your use of the Service.

17.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect. Invalid provisions shall be modified to the minimum extent necessary to make them enforceable while preserving their intent.

17.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

17.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may freely assign or transfer these Terms and our rights hereunder to any successor or affiliate.

17.5 Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, natural disasters, pandemics, government actions, or infrastructure failures.

17.6 Notices

Notices to you may be provided by posting to the Service, by email to your registered address, or by other reasonable means. You consent to receive communications electronically.

17.7 Survival

We reserve the right to modify these Terms at any time. Changes will be effective upon:

Posting the revised Terms on the Service

Your continued use of the Service after changes are made constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service and may request account deletion.
